TERMS OF SALE – ONLINE 

ORDERS 

Products are subject to availability. Production will not begin until the deposit has been received. Please verify the accuracy of quotes and pro forma invoices before approving them. All products remain the property of TPS Co. Ltd. until full payment has been received. 

PAYMENT 

Payment can be made using the following payment methods: 
Juice 
Bank Transfer 

DELIVERY 

The delivery time is as follows: 

Products in store: 

Mauritius—within 7 to 15 business days 

Rodrigues—15 to 20 business days 

International Shipping –  within 15 to 30 business days. 

Products not in stock or custom-made: 

Mauritius and Rodrigues – 8 to 9 business days 

International Shipping 14 to 16 business weeks.

ORDER CANCELLATION 

Once an order has been processed, it cannot be canceled. Deposits paid for services are non-refundable once we have started the project. For any product in stock, you may cancel your order within 48 hours. 

RETURNS AND EXCHANGES 

Since products are tested prior to shipment, TPS Co. Ltd. will not accept any returns or exchanges; all sales are final and non-refundable. 

INTELLECTUAL PROPERTY PROTECTION 

The product designs featured in The Popsicle Studio Ltd.'s catalogs are protected by intellectual property laws. 

Consequently, it is strictly prohibited to manufacture, fix, reproduce, translate, distribute, publicly perform, make available to the public, and/or adapt, in whole or in part, these designs and/or catalogs, as well as to engage in any other act of exploitation in connection with them, without the prior written authorization of the rights holders. 

WARRANTY 

A 12-month warranty applies to electrical appliances (excluding light bulbs). The purpose of this warranty is to ensure the proper functioning of appliances that have suffered an internal malfunction. This warranty will not apply if the installation, maintenance, or use of our product does not comply with our recommendations. Please refer to the warranty exclusions and limitations. 

COMPLAINTS 

All claims under the warranty mentioned above must be submitted in writing, including the customer’s name, address, and phone number, along with digital photos, to hello@popsicle-studio.com. 

EXCLUSIONS AND LIMITATIONS 

The warranty does not apply in the following cases:  

  • Product installed under unsuitable environmental conditions; 
  • products whose factory-assigned serial number has been altered or removed; 
  • installation, maintenance, or use of the product that does not comply with our recommendations, the user or installation manual, or the manufacturer’s instructions or requirements; 
  • Ldamage caused by negligence during installation or maintenance, by unauthorized repairs, or by unauthorized repairs performed using non-genuine replacement parts or non-compliant procedures; 
  • damage caused by excessive mechanical loads that are inconsistent with the Product’s intended use and specifications ; 
  • products damaged by fire, liquid spills, moisture, deterioration, the presence of pests or insects, normal wear and tear, improper configuration of the customer’s control systems, use of an inappropriate voltage, power surges and voltage drops, thunderstorms, cases of force majeure, power supply issues, misuse of the products, damage during transport, installation, or relocation of the product, defects that, in any case, do not compromise the structural and/or mechanical safety of the product; 
  • damage resulting from weather events, malicious acts, or any accidental event that would preclude attributing the defects to the manufacturing process of the pproduct; 
  • paint defects caused by contact with the ground, chemicals, fertilizers, water containing corrosive agents, or stray electrical currents ; 
  •  Product used with a power supply other than the one specified in theproduct catalogs. 

In any case, it is understood that The Popsicle Studio Ltd shall not be liable for any costs other than those related to the repair and/or replacement of the defective Product, such as, but not limited to, disassembly and reassembly costs, any costs associated with accessing the installation site (e.g., scaffolding, elevators, overnight site access, third-party services), the cost of transporting the Product to The Popsicle Studio Ltd’s headquarters, and the cost of returning it to the Customer. Furthermore, no refund and/or compensation may be claimed, and no legal action may be brought against The Popsicle Studio Ltd for damages, whether direct or indirect, of any kind whatsoever, resulting from the use—whether limited or not—of the defective Product and/or its sale.
